It is understood this Studio/Photographer is the exclusive official photographer retained to perform the photographic services requested on this Contract.

Upon accepting the terms below, the Studio/Photographer shall reserve the time and date agreed upon. All session fees are non-refundable if canceled for any reason other than inclement weather. If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait session meeting the artistic standards of the studio/photographer, photographer may elect to use an alternate location or to reschedule the portrait.

No part of any order, including previews, will be delivered until the balance is paid in full.

Studio/Photographer may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.

If the Studio/Photographer cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of all monies paid.

Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

The charges in this Contract are based on the Studio’s/Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

Minimum purchase order of $400*. Any cancellations must pay the minimum purchase at cancellation.

All sales are final. Order must be paid in full before delivery.

**Rescheduling fee of $150 required within 14 days of the session.**

****Ordering sessions take place in-person at my Studio within a week of your session date. The ordering session will take about an hour. 

NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Studio’s/Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties

This Contract incorporates the entire understanding of the parties and is governed by the laws of Burnaby, BC. Any modifications of this Contract must be in writing and signed by both parties.

Studio Policies

1. A $400 minimum purchase not including the session fee is required. This also includes special sales or gift cards throughout the year. Minimum purchase applies to cancellations.

2. All sales are final. Items cannot be returned or exchanged. You may add on to your order at any time, but a sale is considered final at the time it is made.

3. No images will be shared without written consent of client.

4. Digital files are not included with your session fee but can be purchased with one of our collections or on their own.

5. Reschedules due to illness or personal emergencies are required with a 24-hour advance notice. Within 14 days, $150 rescheduling fee. Within 24 hours, another session fee will be required to hold your date/time.

6. All sessions booked with a special pricing(example: Black Friday, Cyber Monday, etc.) can not be canceled nor have a discount applied on top of. If the booked session is canceled, the client forfeits that special price. The session fee from the special price will remain on the client's account for a period of one year as a credit and can be used towards a new session fee, and cannot be combined with other sales, discounts or coupons.

7. Attendance at the session is limited to the client only, as it throws off the whole vibe of the session. Husbands, boyfriends, and significant others are asked to stay home.

8. Sessions will remain on file for one year. Additional orders can be placed within this time frame.

9. Gina Spanos Photography is not responsible for personal items/valuables left at the studio.

10. In the unlikely event of data loss, camera equipment malfunction or photographer illness that prevents the undertaking of the session. The photographer’s liability will be limited to the refund of all session fees, or a new session can be scheduled at no additional cost to the client.

11. Ordering sessions take place in person at the studio, with a minimum purchase requirement of $400 due at time of appointment.

12. Client is responsible for making sure hair and makeup is exactly the way she wants it. Limited retouching services ARE possible to correct skin tone, increase or decrease intensity, but it's not guaranteed it will work. If client does not love hair and makeup, please let makeup artist know BEFORE starting the session.
